End User License Agreement
Parted Magic LLC

This End User License Agreement (“Agreement”) is a legal contract between you (“Licensee”) and Parted Magic LLC, a Wisconsin limited liability company (“Parted Magic LLC”, “we”, “us”). It governs your use of the Parted Magic software (“Software”), including the bootable ISO image, the proprietary applications developed by Parted Magic LLC (including but not limited to the Erase, VisParted, Clonezilla, and Drive Grader utilities), the documentation, and any updates we provide.
By purchasing, downloading, or using the Software, you agree to this Agreement. If you do not agree, do not download or use the Software.
1. License Grant
Subject to your compliance with this Agreement and payment of the applicable fees, Parted Magic LLC grants you a non-exclusive, non-transferable license to use the Software for your own purposes, including commercial and for-profit purposes such as IT asset disposal, managed services, refurbishment, data recovery, and consulting work.
A single license entitles a single organization (whether an individual, a household, a business, or an institution) to use the Software on as many computers, boot media, and drives as that organization needs. There are no per-seat, per-technician, or per-drive limits.

Subscription cancellations stop future billing but do not refund the current period. Software you have already downloaded continues to function indefinitely regardless of subscription status.
3. Refunds
Subscription and Single Version purchases are covered by a 14-day money-back guarantee. To request a refund within 14 days of purchase, reply to your order confirmation email.
Forever and Enterprise Compliance License purchases are non-refundable. All sales of these tiers are final.
4. Bundled Open-Source Software
The Software includes a number of open-source components, each governed by its own license (including but not limited to the GNU General Public License versions 2 and 3). Nothing in this Agreement modifies, supersedes, or limits the rights granted to you under those licenses with respect to the components they cover. The full text of those licenses, and the source code for components that require it, is available from Parted Magic LLC on request.
This Agreement governs the proprietary components of the Software developed by Parted Magic LLC and the integrated Software as a whole, not the upstream open-source components individually.
5. Account and Download Access
Your purchase confirmation email contains a download link that expires 24 hours after issuance. Continued access to current and updated downloads is available through your account at partedmagic.com for the duration of your license entitlement (indefinitely for Single, Forever, and Enterprise tiers; for the active subscription period for Subscription tiers).
You are responsible for keeping your account credentials secure. Notify us at sales@partedmagic.com if you believe your account has been compromised.
6. Disclaimer of Warranty
THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
The Software performs destructive operations including but not limited to drive erasure, partition deletion, and filesystem modification. These operations are irreversible. You are solely responsible for selecting the correct drives, backing up data before use, and verifying results.
Parted Magic LLC does not warrant that the Software will be error-free, that erasure will succeed on every drive, that certificates will satisfy any specific auditor or regulatory body, or that the Software is compatible with any particular hardware configuration.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARTED MAGIC LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF PARTED MAGIC LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
PARTED MAGIC LLC’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE SOFTWARE, FROM ALL CAUSES OF ACTION AND UNDER ALL THEORIES OF LIABILITY, SHALL NOT EXCEED THE AMOUNT YOU PAID PARTED MAGIC LLC FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
These limitations apply regardless of whether the claim is based on contract, tort, strict liability, or any other legal theory.
8. Termination
This Agreement remains in effect until terminated. You may terminate at any time by ceasing to use the Software and deleting all copies. Parted Magic LLC may terminate this Agreement if you materially breach it, including by failing to pay applicable fees or by misusing the Software. Sections 4, 6, 7, and 9 survive termination.
9. Governing Law
This Agreement is governed by the laws of the State of Wisconsin, USA, without regard to its conflict-of-laws provisions. Any dispute arising out of or related to this Agreement shall be brought exclusively in the state or federal courts located in Waupaca County, Wisconsin, and you consent to the personal jurisdiction of those courts.
10. Entire Agreement
This Agreement, together with the terms shown at checkout for your specific license tier, constitutes the entire agreement between you and Parted Magic LLC regarding the Software. It supersedes any prior agreements or understandings on the same subject. If any provision is held unenforceable, the remaining provisions remain in full force.
